Collaborative Law offers our Atlanta area clients an alternate approach to settling their divorce issues, rather than through traditional litigation. The law firm of Deborah M. As the name implies, in a collaborative divorce, the wife and husband agree to work together in the divorce process, in hopes of avoiding the possibility of litigation that is used in a typical divorce.

  • Commitment - A collaborative divorce involves an initial commitment from both parties to forego litigation until a settlement agreement has been reached and signed by the parties involved. The focus of the process is to identify and resolve issues in a cooperative manner with the goal of reaching an amicable resolution prior to filing anything with the court.

  • Resources - The collaborative process involves each party having their individual interests represented by their attorney. There can also be other professionals who come in to assist the collaborative team, such as a parenting coordinator, a financial advisor or analyst, and a coach to assist them on an emotional level.

  • Benefits - Because collaborative divorce is a commitment by both parties to resolve their issues without litigation, much of the stress involved in a divorce can be eliminated. The process facilitates the couple into determining their own future. It allows them to pool resources to resolve their issues without duplicating costs and wasting money on court costs.

Issues of custody and visitation, child support, and other aspects of a divorce are still addressed in Collaborative Law. A collaborative divorce may not work for all couples, but it can offer them a means of hope and comfort they may not feel is possible in a traditional divorce. It offers more freedom to find a solution that works for everyone.
