Alimony

Atlanta, Georgia, Alimony Attorney

How much alimony will I get? How much alimony will I have to pay? These are the two fundamental questions related to spousal support in almost any divorce proceeding. The answers to these two questions are not simple. The court looks at several significant factors in determining how much money a spouse will pay or receive.

At the law firm of Deborah M. Lubin, P.C., we look at these factors as well in helping you prepare for tomorrow. Looking ahead toward the future is really a foundational element of our practice. How is Alimony Determined?

When the courts decide how much spousal support one party will pay to another, several factors are considered: such as the duration of the marriage, the lifestyle to which each person is accustomed, the financial and other contributions to the marital estate, and each individual’s education and earning potential. In our representation of clients we also bring to light additional factors that influence this determination. Was money you invested in the marriage wasted by your spouse? Did you put your life on hold so that your spouse could complete necessary education or training to pursue a profession?

Alimony and Taxes

Many spouses who will be paying alimony bristle at the thought of having to provide financial support to an ex, often wanting to give the other party more property rather than having to make seemingly large support payments. We explain to our clients the tax benefits of paying alimony and any possible drawbacks of receiving alimony. Alimony is tax deductible to the payer and it has a terminal date. In addition, it is considered taxable income to the receiver. In cases of an extreme disparity between the couple, paying or receiving alimony may make sense.
